Everything You Should Know About A & B Khata

Khata extract or Katha certificate is a document used for tax payments and contains property-related details across Karnataka. The contains important property details necessary for every property owner in the State. These Khata's are categorized into 2 types A and B katha. 

Khata extract or Khata certificate is a legal document, which represents an account of the assessment of a property. The document is required for the purpose of tax payments in the state of Karnataka, predominantly in Bangalore. Details that are required for filing property tax, such as the owner’s credentials, location, carpet area, and property tax ID number, are included in this particular document.

The Khata concept came into being after the BBMP was formed in 2007 to simplify the collection of property taxes from the residents of Bangalore. Before 2007, the collection of property taxes was a big hassle for the authorities as there were 3 different bodies that collected and had a stake in collection of taxes.

To reform the process of tax collection and reduce redundancy, the concept of A Khata was introduced by the BBMP. The first register, called A Khata listed the fully legal properties in Bangalore, while a separate register called b Register was maintained by the BBMP listing the illegal/semi legal properties in the city. This came to be known as B Khata by authorities.

Importance: 

The Khata certificate is essential for getting any document related to the construction or sale of a property sanctioned. This document allows you to obtain a trade license, building license, building plan approval and loans from financial institutions. It is also necessary when applying for a water or electricity connection in Bangalore with the Bruhat Bengaluru Mahanagara Palike (BBMP) or for selling a property.

What is the Difference Between A Khata and B Khata?

‘A’ Khata certificate is issued to a legal property that abides with all building byelaws, taxation norms and government regulations. This certificate makes the process of applying for a home loan, building plans and Occupation Certificate easier.

The A Khata came into being to streamline Property Tax collection by the local authorities. The A Khata denotes a document that certifies that the property owner has duly paid relevant property taxes to the BBMP and is in ownership of a legal property.
With an A Khata in hand, property owners can apply for trade licenses, building licenses or avail loans on the property. Your property is effectively legal if you have the A Khata documents, which will be required when you go for any other financial transaction related to your property in Bangalore.

The B Khata is a separate register maintained by the BBMP that lists the illegal properties (as per Karnataka High Court order in December 2014) that have ownership in the city of Bangalore

‘B’ Khata is provided to those properties that are in violation of building bye-laws and government norms and have pending property tax dues to be cleared. This is a temporary certificate which needs to be converted to A Khata by paying betterment charges or conversion fees to the concerned authorities.

The B Khata properties can be upgraded to A Khata properties by fulfilling a few criteria such as payment of all property taxes till date, DC converted property and payment of Betterment Charges as levied by the BBMP.

Additionally, there exists another category called E Khata, which refers to the certificate issued online, by which the owner of the property can also clear their property tax dues online.

Major Differences Between A Khata and B Khata

Given below are the major differences between A Khata and B Khata property titles:

A khata:

1. Recognized as Legally property.
2. Property can be resold or ownership transferred.
3. Trade licenses can be obtained.
4. Construction permits and clearance can be obtained and properties can be expanded.
5. Loans can be availed on and for the property.
6. Final document that certifies that the property is legal and trade-able.
7. Owners can apply for trade licenses and building license.
8. These properties are easy to transfer and sell.
9. Owners can easily renovation or apply for construction.
10. No restriction from any government body as all NOC’s will be taken.

B khata:

1. Recognized as Illegal property even if the ownership documents are present.
2. Property cannot be/ difficult to resold or ownership transferred.
3. Trade licenses cannot be obtained.
4. There are restrictions on property expansion.
5. Loans cannot be availed
6. Temporary document that needs to be upgraded to A Khata to avail the complete set of services associated with owning a property in Bangalore
7. Owners are restricted to applying for trade licenses
8. These properties are not easy to transfer and sell.
9. Owners cannot easily renovate the property or apply for construction.
10. Chances of restriction from government body is possible as no all NOC’s are taken.

B Khata properties used to enjoy some of the rights that A Khata properties have but the recent Karnataka High Court order given in December 2014 nullified whatever legal status they had. 

As of now, B Khata properties are categorized as illegal properties and have to be converted to A Khata properties to avoid complications in trading, construction and transferring of the property.

How to convert B Khata to A Khata?

In order to Covert B khata property to A khata and to recognized by the local municipal authority and consider to establish legal ownership of the property, obtain bank loans and get civic benefits. 

The conversion procedure is as follows:

1. You must first gather all the relevant documents required for Khata registration along with the common application form.
2. Then proceed to pay the BBMP Betterment Charges, a fee levied specifically for the conversion of B Khata to A Khata.
3. Submit the filled in form along with the tax receipts and documents to the Assistant Revenue Officer of the area and get your property assessed.
4. After assessment, you must pay any pending property tax dues. Following this, you will receive the A Khata extract issued in your name.

Documents required to convert B khata to A khata

The following documents are required to convert B khata to A khata:

1. Title deed
2. Sale deed
3. Order of conversion of the land from agricultural to non-agricultural use
4. Copies of previously paid property tax receipts
5. Blueprint showing property’s dimensions and other specifications
6. Blueprint showing property’s location
7. Occupancy certificate
8. Proof of any improvement charges paid
9. Khata extract
10. Any other document, as required for the conversion
